These Terms of Service govern your access to and use of BevOps Connect (the “Service”), which is provided by The Web People Inc. (“we”, “us”, or “our”). By using the Service, you agree to these Terms.
The Service is an independent software product. It is not affiliated with, endorsed by, authorized by, or officially supported by the Liquor Control Board of Ontario (“LCBO”) or any related entity.
The Service is intended only to assist users with their own workflow while using the LCBO Gateway or related systems. You may use the Service only if you are authorized to access and use those systems. You are solely responsible for ensuring that your use of the Service complies with all applicable laws, agreements, workplace policies, and third-party terms and conditions.
You are responsible for all actions taken using the Service and for reviewing any outputs, files, confirmations, or other results generated through the Service before relying on them or submitting anything. The Service is a productivity aid only and does not replace your own review or judgment.
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, representations, and guarantees, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, compatibility, or uninterrupted operation.
We do not guarantee that the Service will be error-free, secure, uninterrupted, or compatible with any current or future LCBO systems, pages, workflows, or requirements.
To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or opportunity, arising from or related to your use of, or inability to use, the Service.
Without limiting the above, we are not responsible for any account restrictions, suspensions, workflow interruptions, incorrect outputs, data loss, system changes, or other issues arising from use of the Service.
If we are found liable for any claim relating to the Service, our total liability will not exceed the amount you paid us for the Service in the three (3) months before the event giving rise to the claim.
The Service interacts with third-party websites and systems that we do not own or control. We are not responsible for any third-party system, content, availability, security, policies, or changes, including any changes that affect the performance or availability of the Service.
We may modify, suspend, or discontinue the Service at any time, with or without notice. We are not liable for any resulting impact on your use of the Service.
If the Service is offered on a subscription basis, you agree to pay the fees presented at the time of purchase. Unless otherwise stated, subscriptions renew automatically until cancelled. You may cancel at any time, but fees already paid are non-refundable except where required by law.
We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms or if continued access may create legal, security, or operational risk.
These Terms are governed by the laws of the Province of Nova Scotia and the laws of Canada applicable therein, without regard to conflict of laws principles. Any dispute arising from these Terms will be brought in the courts located in Nova Scotia, Canada.
